Image Use & Licensing

I put a big part of myself into each and every photo you see, and I am honored that you would like to acquire a copy for yourself. That said, I appreciate your taking the time to review the information on this page so we can try to avoid any misunderstandings.

Copyright Notice
Unless otherwise noted, all images on burke-photography.com (“website”) are the property of William Burke and Billy Burke Photography and are protected from copying, scanning or reproduction by United States copyright law (17 U.S.C. §101 et seq.) and international copyright conventions. Unauthorized use is strictly prohibited and copyright violations WILL be pursued to the fullest extent possible. Purchasing a print or digital download does not transfer ownership, additional usage, or reproduction rights; unless otherwise agreed in writing, copyright remains with Billy Burke Photography. Commercial licensing terms will be arranged on a case-by-case basis.

Restrictions on Use
The Client (and any third party accessing the work) is granted a limited license to use the photographs solely for the purposes expressly authorized in writing. The purchase of a print does not grant reproduction rights. Please contact me for additional prints.

Digital Licensing

Personal Use – Usage rights for digital images are non-transferable and intended for use ONLY by the original purchaser on social media and for creating a single (up to) 4″x6″ print on a home printer. Commercial printing of the image is strictly forbidden without prior written consent. You’re welcome to post and share the images as-is (with the watermark intact and without change to composition, color, etc.) on non-business social media accounts. Please provide credit in a way that fits the platform’s format. The image must not be altered, including watermark removal. Fees start at $10. Resale and distribution, outside of posting on personal social media, without permission is strictly forbidden.

Professional\Commercial High-Resolution – Logo free and print-ready for commercial use. Licensing and usage terms will be based on how you intend to use the image. “Commercial use” includes marketing, advertisements, product packaging, etc. Fees start at $150.

Printed Works

Purchasing a printed image does not transfer ownership or usage rights. Copying, reproduction, or resale in any form without permission is strictly prohibited.

Collaborative Work

If you’re a creative looking to collaborate on a project or want to use an image as part of a composite, I’d love to hear your idea!

Prohibited Uses
The following uses are expressly prohibited without prior written consent from Billy Burke Photography:

1. Use of photographs in the training, development, fine-tuning, or evaluation of any artificial intelligence (AI) or machine learning systems.
2. Uploading, contributing, or otherwise distributing photographs to any dataset, image repository, or service that may be used for AI training.
3. Creation of derivative works via generative AI systems.

Reservation of Rights
Any unauthorized use, including but not limited to AI training, will be considered a material breach of this agreement and may result in legal action, including claims for damages, injunctive relief, and recovery of attorney’s fees.
